Terms & Conditions.
All work undertaken by Bare Root Gardening incorporates the following Terms and Conditions. Please read them carefully, they have been written to provide a clear and transparent framework to all that we do which helps protect both Bare Root Gardening and all of its clients.

1. Definitions
1.1. 'We' refers to colleagues of Bare Root Gardening.
1.2. 'The company' and 'BRG' refers to 'Bare Root Gardening' and associated colleagues.
1.3. 'Client' and ‘customer’ refers to a person potentially or having had work carried out by Bare Root Gardening.
1.4. 'Works' refers to quoted or carried out tasks done by Bare Root Gardening.
1.5. ‘Unless agreed otherwise’ refers to verbal and/ or other communication, often via text or email.
2. Scope of Work
2.1. All works undertaken by BRG shall be in accordance with these Terms and Conditions.
2.2. BRG shall carry out and complete all works described in the consultation in a professional manner.
2.3. BRG shall have no obligation to provide or complete additional work unless agreed in writing with the customer.
2.4. BRG shall comply with all reasonable customer requests and directions in relation to works undertaken.
3. Quotation
3.1. Costs for proposed works are valid for 30 days from the date of the quotation/ consultation. If you wish to proceed and notify us after 30 days a new quotation may be required. We try to avoid increasing prices, however sometimes it is unavoidable.
3.2. All quotations are based on conditions assessed at time of viewing the proposed work and information divulged by the client.
3.3. The client will pay additional costs relating to extra works due to unknown difficulties or changes not divulged or explained at time of viewing and therefore not listed in the quotation.
3.4. BRG reserves the right to increase the prices mentioned in a quote, with prior notification to the client. Price increases will only relate to factors outside BRG control. Some examples are increases to raw materials, plants or fuel.
3.5. Any special needs, requirements or conditions such as access issues or problem neighbours will be detailed in the quote.
3.6. It is the responsibility of the client to ensure BRG are aware of any relevant local bylaws, conditions or permissions that may be involved in the works.
3.7. BRG accepts no responsibility carried out on land not under ownership of the client. It is assumed that all necessary regulations, laws and permissions have been applied and/or agreed prior to the commencement of any works.
4. Contract
4.1. Work is contracted by the customer, and is carried out under the customers’ instruction, unless agreed otherwise. Timings and hours are agreed before arrival and/ or during the consultation.
5. Advice and Planning
5.1. Advice and planning is done during contracted hours, unless agreed otherwise. External agreed planning and design works may be charged at a different rate and subject to agreement with the customer.
6. Materials and delivery
6.1. Extra materials can be bought by BRG if agreed. If item/s are large/ heavy, a reasonable delivery charge for the fuel and time may be added.
6.2. Deposits may be required where relevant, such as for materials such as plants before commencement of work which will be discussed and agreed with customer.
7. Equipment
7.1. Equipment used is provided and maintained by BRG. In certain cases where the clients’ equipment may be used, this agreed prior by both the client and BRG.
7.2. All fuel needed for machinery such as petrol for lawnmowers is provided by the client, unless agreed otherwise.
8. Delays, Disruption and Force Majeure
8.1. Work may need to be rescheduled in accordance with the weather or emergencies, and will be communicated as soon as possible.
9. Accidental Damage and Liability
9.1. The company has public liability insurance to cover any unfortunate accidents may they occur.
10. Invoicing & refunds
10.1. Invoices will be provided promptly as possible in written format. In return, payment is expected promptly, unless agreed otherwise.
10.2. BRG does not provide refunds for work undertaken, plant or other materials. BRG ensures the upmost quality and care given to all aspects of the services provided.
11. Photos and Videos
11.1. Photos and videos may be taken before, during, and on completion of works.
11.2. Media may be used publicly in advertising, social media, and so on. All media will be anonymous and discrete to secure privacy.
11.3. Clients can opt out of future media by discussing this with the company at any time.
Customer obligations & responsibilities
12. Payment
12.1. Payment is due as soon as possible after the work is completed and invoice received.
12.2. Payment may be made via BACS or cash. Cheques are not accepted.
12.3. Payments made over two weeks from invoicing may be liable to reasonable surcharges, and/ or stopping work until previous invoice/s are paid.
12.4. Continuation of non payment may result in court action, and/ or removal of paid for goods from the client premises if applicable.
13. Supply of Plants and Living Matter
13.1. Plants are cared for and bought at garden centres to the highest standard BRG can procure and provide. Plant death is a natural part of the garden and may occur, BRG does our best to ensure this happens as little as possible.
13.2. Watering of plants is the customers’ responsibility, unless agreed otherwise.
14. Cancellation
14.1. Clients may reserve the right to cancel for any reason.
14.2. Cancellations within 24 hours of the agreed visit time may be charged at full price, if no reasonable reason is found.
15. Waste Disposal
15.1. Waste can’t be removed from the property by BRG. Waste will be put in the green bins or given waste/ compost area unless agreed otherwise.
15.2. It’s the customers’ responsibility to empty their green bins.
16. Animals
16.1. Damage to plants caused by wild, other peoples’ animals, or the clients’ animal/s is not the responsibility of BRG. BRG prioritises mitigation of plant damage by all animals and takes measures as agreed with by the customer.
16.2. BRG cannot touch, remove, strim or mow animal poo, for health and safety reasons.
16.3. BRG reserves the right to stop working if excessive barking occurs and is also persistent. Excessive barking causes disruption, poses a health and safety risk, plus prevents a great job from being done.
16.4. If conditions are found to continue after reasonable discussion to prevent the above from occurring, BRG reserves the right to leave the the visit and be paid the full amount for the agreed time.
17. Watching
17.1. Whilst BRG provides a high standard of customer care and can give advice and educate people in their gardening, staff can’t work whilst being persistently watched/ hovered over, unless agreed otherwise. BRG aims for any learning to be engaging and respectful.
17.2. Staff reserve the right to leave work and get paid for the contracted hours, if watching is persistent.
Law
These terms and conditions apply to the use of this website and/or any contract between us. Both shall be governed by and construed in accordance with English law and English courts shall have exclusive jurisdiction over any disputes.
